1. Introduction
These Terms and Conditions govern the provision of drainage services by Local Services Drainage ("we", "us", "our") to the customer ("you", "your"). By booking our services, you agree to be bound by these Terms.
These Terms comply with applicable UK legislation including the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
2. Services Provided
We provide drainage services including but not limited to:
- Drain unblocking
- CCTV drain surveys
- Drain repairs and installations
- Drain relining
- Planned maintenance
All services will be carried out with reasonable care and skill in accordance with UK law.
3. Quotations and Pricing
- All quotations are valid for 30 days unless stated otherwise.
- Quotes are based on visible conditions; additional work may be required if unforeseen issues arise.
- We will inform you before carrying out additional chargeable work.
- A 50% deposit is required for larger works (e.g. drain relining), with the remaining balance due upon completion.
4. Consumer Cancellation Rights (Non-Emergency Work)
- If you are a consumer, you have a legal right to cancel within 14 days of booking (cooling-off period).
- If you request work to begin within this 14-day period, you must provide express consent.
- If work has started, you will be liable for reasonable costs for work completed up to cancellation.
5. Emergency and Urgent Works
Where you request immediate or emergency attendance, you acknowledge and agree that:
- Work may begin immediately.
- Your 14-day cancellation right will be lost once the service is fully performed.
- You are liable for all costs once work has commenced.
- Emergency call-outs are charged at a premium rate.
6. Access and Customer Responsibilities
- You must provide safe, clear, and adequate access to the work area.
- You are responsible for removing obstructions (e.g. flooring, fixtures) unless agreed otherwise.
- You must inform us of any known issues (e.g. previous repairs, structural problems).
- We are not responsible for delays or additional costs caused by restricted access or inaccurate information.
7. Cancellations and Deposits
- No cancellation fee is charged unless a deposit has been paid.
- Deposits are non-refundable where materials have been ordered or labour has been scheduled or costs incurred.
- We reserve the right to retain part or all of the deposit to cover reasonable losses.
8. Guarantees
We provide a 10-year guarantee on drainage repairs, installations, and relining works.
This guarantee does not cover:
- Blockages or routine maintenance
- Misuse, negligence, or improper use of the drainage system
- External factors (e.g. ground movement, root ingress, third-party damage)
Guarantee validity may depend on proper use and maintenance of the system.
9. Payment Terms
- Payment is due immediately upon completion unless otherwise agreed in writing.
- We reserve the right to charge statutory interest under the Late Payment of Commercial Debts (Interest) Act 1998.
- We may recover reasonable costs incurred in collecting overdue payments.
10. Liability
We are responsible for providing services with reasonable care and skill. We are not liable for:
- Pre-existing defects or hidden damage
- Issues outside our control
- Consequential or indirect losses (including loss of income or business)
Our total liability is limited to the value of the work carried out.
Nothing in these Terms limits or excludes liability where it would be unlawful to do so, including for death or personal injury caused by negligence.
11. Damage and Claims
- We will take reasonable care while carrying out work.
- Any claims for damage must be reported within 48 hours of service completion.
- Evidence (photos/videos) may be required to support claims.
12. CCTV Surveys and Evidence
- CCTV surveys are provided as a visual inspection based on accessible areas.
- Recordings may be retained for evidence and quality purposes.
- We are not responsible for issues not visible at the time of inspection.
13. Complaints
If you are dissatisfied, please contact us. We aim to resolve complaints promptly and fairly.
14. Alternative Dispute Resolution (ADR)
We are not currently registered with an Alternative Dispute Resolution provider. However, we will always attempt to resolve disputes directly with you.
15. Governing Law
These Terms are governed by the laws of England and Wales. By booking our services, you confirm that you have read and agree to these Terms and Conditions.
